What is a cookie?
It is a file that is downloaded to your computer or other device when you access certain web pages that collect information about your browsing on that website. 2. General conditions for accessing the Web and requesting Web Services
The contents, commercial activities and services in general provided through the Web are subject to the terms and conditions set forth in this notice (hereinafter, “Terms of Service”).
Consequently, the simple access to the Web by any person implies the attribution to the same of the condition of User (hereinafter, the “User”) and the full acceptance of these Terms of Service.
As a general rule, access to the Web, as well as the use of any of the services provided from the Web are completely free and suitable for anyone over 18 years of age.
Exceptionally, THE ON-LINE STORE SERVICE IS EXCLUSIVELY RESERVED TO BUSINESSES AND PROFESSIONALS IN THE HOSPITALITY AND RESTAURANT SECTOR WITH SUFFICIENT LEGAL CAPACITY TO LINK WITH MIMCOOK and is subject to the prices, taxes and other charges described on the Web.
The User of the Web that does not have the aforementioned status of entrepreneur or professional can not purchase Mimcook products through the online store for home use and should go directly to the customer service Mimcook.
Mimcook may transfer personal data to the competent administrations and authorities for the fulfilment of legal obligations, as well as to the WordPress company. In this case, the data may be transferred within and outside the European Economic Area (hereinafter “EEA”).
The User’s rights are to access, rectify, oppose, limit the processing, portability and suppression of personal data and the right to complain to the Spanish Data Protection Agency. The User also has other rights which are detailed in the additional information.
4. Commercial mail policy
In accordance with current legislation Mimcook does not engage in spamming practices, so it does not send commercial emails that have not been previously requested or authorized by the user.
The User may revoke this consent at any time by writing to the postal or e-mail address of Mimcook.
Exceptionally, and in accordance with Article 21.2 of Law 34/2002, of July 11, 2002, on information society services and electronic commerce, the User who has purchased any of Mimcook’s products or services is informed that their e-mail address may also be used by Mimcook to send them, without their prior consent, commercial information about other Mimcook products or services that are similar to those that were initially contracted. However, the User may object at any time to the sending of such commercial mailings by writing to the postal or email address of Mimcook.
5. Intellectual and industrial property
The trademarks, trade names or distinctive signs, as well as the design and all content and elements (graphics, video, audio, etc.) that are part of the Web are the property of Mimcook and are protected by intellectual and industrial property laws. Consequently, Mimcook does not authorize the adaptation, alteration or creation of material or information on this website or its use for purposes other than personal non-commercial use.
However, the User is authorized to make links to the Web as long as the identity of the owner is recorded, it does not involve a violation of current legislation and the pages or sites of the Network through which the link is made does not violate morality, public order and good customs and are respectful of the principles of non-discrimination and respect for the dignity of the person, the protection of youth and childhood and, in general, all those other principles and values contained in Article 8 of Law 34/2002, of July 11, 2002, on information society services and electronic commerce.
Mimcook reserves the right to request the user to remove links to the Web at any time or under any circumstances.
Mimcook is not the owner of the other sites on the Web that can be accessed through the use of links or hyperlinks on the Web. Consequently, the User will access their respective contents and conditions of use under their sole responsibility.
6 General Conditions of Purchase
If you are interested in purchasing one of Mimcook’s products through the online shop service, please read the following conditions carefully before starting the purchase process.
6.1. General Conditions of Purchase and their acceptance.
As a User, you declare that you are of legal age and have sufficient legal capacity to be bound by these GTC when contracting with Mimcook.
To make a purchase through Mimcook’s online store, the User must accept the GTC before finalizing the purchase process in the version published by the Web at the time of the last transaction.
Consequently, Mimcook reserves the right to modify the commercial offer presented on the website and its GTC (modifications on products, prices, costs, promotions and other commercial conditions), being applicable to the purchase made by the User the GTC that had been accepted at the end of the purchase process, by clicking on the tab with the heading “I accept the conditions” or similar.
The present GTC are only available in English and Spanish language ***************.
6.2. Coverage of the online shop.
As a User, you declare that you are of legal age and have sufficient legal capacity to be bound by these GTC when contracting with Mimcook.
The on-line shop service IS EXCLUSIVELY RESERVED FOR BUSINESS PEOPLE AND PROFESSIONALS IN THE HOSPITALITY AND RESTAURANT SECTOR.
If the User does not have this condition and wishes to purchase a Mimcook item for domestic use, he/she should contact customer service directly.
To make a purchase through the on-line shop it is not necessary for the User to register previously on the Web.
The articles offered through Mimcook’s online shop are distributed where EC safety regulations are in force.
6.3. The articles and information provided on the Web.
All items in the online shop are a selection of Mimcook products and the Web offers the User a wide range of information on these items, such as: colour, measurements, instruction manual by downloading in Pdf document, technical specifications, price, applicable taxes and shipping costs.
Mimcook makes every effort within its means to provide the information contained on the Web truthfully and without typographical errors, as well as to show the colors of the articles as true to reality as possible. However, the color of the items displayed on screen may be subject to variations depending on the quality of the User’s computer monitor.
6.4. Prices, taxes, expenses and payment method.
All prices include separately a detail of the legally applicable taxes (VAT) and shipping costs.
The prices in the online shop are shown in euros.
When the User places an order for delivery in a country outside the European Union, you may be required to pay import duties and taxes, which will be charged at the time the package arrives at its destination. Any additional amount due to customs clearance shall be borne by the Customer and Mimcook has no control over such amounts and does not provide any information on such amounts as they vary significantly from case to case.
In payments by PayPal or credit or debit card, the charge will be made in real time through the payment gateway of the financial institution, once the authenticity of the data communicated has been verified. The payment gateway system used offers maximum security and the payment data is transmitted directly and encrypted (SSL) to the corresponding financial institution.
Confirmation of receipt of the order will be communicated to the User by sending an email.
6.5. Shipping costs and delivery times.
The shipping costs of items purchased through the online store are borne by the User.
Mimcook cannot confirm a specific delivery date in advance, as this will depend on each case. In any case, delivery will be made within 30 days of receipt of your order, unless otherwise agreed.
Orders will be shipped during business hours. Therefore, to avoid incidents in the delivery, the User must indicate the address where the order can be delivered during these hours, as well as a contact telephone number.
Mimcook does not ship to PO Boxes.
If for reasons of force majeure the order cannot be delivered, the total amount of the purchase will be refunded.
Mimcook is not responsible for delays in cases of force majeure, such as: interruption of the activity or total or partial strike of postal services and means of transport or communications, etc..
6.6. Return policy.
Mimcook does not accept returns once the product has been used. The amount of the refund will always be refunded once the condition of the returned mimcooks has been checked. Any damage caused to returned mimcooks shall be at the customer’s expense unless otherwise agreed.
6.7. Mimcook guarantee.
The warranty period will be two (2) years from the date of purchase and will expire automatically after this period, whether or not the warranty has been used. If it is used, a new warranty period will not commence, although the repair carried out, and only in respect of the same, will maintain its warranty for the legal period.
The application and validity of the guarantee shall be conditional on the following two circumstances:
– that the Mimcook has been used properly and correctly and, therefore, the repair will be refused if it is proven that the purchaser has misused the appliance or used it in a way that is contrary to the instructions.
that the buyer has transferred the use and/or ownership of the Mimcook to a third party.
In either of the two previous cases, the breakdowns produced will not be covered by the Mimcook guarantee.
The warranty includes repair, both labor and materials and must always be carried out by Mimcook’s technical service. Repairs carried out by third parties outside this technical service will not be accepted. The repair will be carried out in the shortest possible time. The execution of the guarantee shall replace the right to any indemnity or financial compensation.
The Mimcook guarantee will be immediately forfeited if the unit is damaged, shows signs of misuse or total or partial intentional destruction and/or has been tampered with by personnel outside Mimcook’s technical service.
6.8. Applicable law and jurisdictional submission.
These GTC and the purchase contract are governed and interpreted by Spanish law.
For any action or claim derived from the interpretation and/or fulfilment of the Contract or any of the agreements contained therein, the Parties submit to the jurisdiction of the Courts and Tribunals of Barcelona, expressly waiving their own jurisdiction and domicile, if any other.
The User can obtain the GTC in English. However, in the event of any discrepancy regarding the interpretation and content of the GTC, the Spanish version shall prevail.
